Welcome to Morch. By accessing and using our platform, you agree to these Terms of Service. We recommend reading them carefully.

1. Definitions

"Morch", "we", or "the Platform" refers to the AI-powered interview platform operated by Chim Labs.

"User" means any individual or entity that accesses or uses the Platform, whether as a research project creator or as an interview participant.

"Project" means a set of interviews configured by a User to collect information from participants.

"Participant" means any person who responds to an interview within a Project.

2. Use of the Platform

Morch provides artificial intelligence tools to facilitate automated interviews for user research, product feedback, and insight collection. The User agrees to use the Platform only for lawful purposes, not collect sensitive information from Participants without their prior informed consent, not use the Platform for fraudulent, deceptive, or rights-infringing activities, and respect the privacy and dignity of Participants at all times.

3. User Accounts

To create Projects on Morch, you must register an account. You are responsible for maintaining the confidentiality of your access credentials and for all activities that occur under your account.

4. Intellectual Property

All content, design, source code, artificial intelligence algorithms, and trademarks associated with Morch are the exclusive property of Chim Labs or its licensors. Data and content generated by Users within their Projects remain the property of the respective User.

5. Artificial Intelligence and Automated Interviews

Morch uses artificial intelligence models to conduct interviews. The User acknowledges that AI-generated responses are support tools and do not replace professional judgment, Morch does not guarantee absolute accuracy of transcriptions or AI-generated summaries, and it is the User's responsibility to review and validate information collected through the Platform.

6. Privacy and Personal Data

The processing of personal data is governed by our Privacy Policy, which forms an integral part of these Terms. By using Morch, both Users and Participants consent to the processing of their data in accordance with said policy.

7. Limitation of Liability

Morch is provided "as is" and "as available." To the extent permitted by applicable law, we do not guarantee that the Platform will be free from interruptions or errors, we shall not be liable for indirect, incidental, special, or consequential damages arising from the use of the Platform, and our total liability shall not exceed the amount paid by the User in the preceding 12 months.

8. Termination

We reserve the right to suspend or terminate access for any User who breaches these Terms, without prior notice and without liability.

9. Modifications

We may update these Terms at any time. Changes will take effect upon being published on the Platform. Continued use of Morch after any change constitutes acceptance of the modified Terms.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of the United Mexican States. For any dispute arising from these Terms, the parties submit to the jurisdiction of the competent courts of Merida, Yucatan, Mexico.
